The Trade to Save Terms and Conditions are intended to set the foundation to allow users to conduct their trading in a safe and secure environment

1. Accepting Trade to Saves Terms and Conditions
   By registering as a member of Trade to Save you agree to accept these Terms and Conditions. Should you not accept, you must abstain from using the Trade to Save site and all the associated services provided.
   
   
2. Modification and Revisions to Trade to Save Terms and Conditions:
   These Terms and Conditions will be amended from time to time at the discretion of Trade to Save and become effective immediately upon posting. As a continued user of the Trade to Save service it is your responsibility to remain familiar with any modifications and revisions made to the Trade to Save Terms and Conditions.



3. Legal age for trading
   Legally binding contracts can only be entered into by individuals who are 18 years or older. By registering with Trade to Save, either as a full or casual member you are declaring your age to be 18 years or older to allow legal trading with other registered members of the Trade to Save.



4. Provision of your personal details
   Upon registering with Trade to Save you agree that the personal information you have provided is accurate and correct insuring honesty and user integrity. You will be responsible for insuring your personal details are kept up to date and that your password will be kept safe and secure and not be disclosed to other people. You must not register as a member under multiple identities. Trade to Save may on occasion confirm with registered users the validity of their details.



5. Provision of Service
   The Trade to Save website provides a facility where members can buy, sell and exchange nominated trade items. Trade to Save does not participate in any way in the sale, exchange, or bartering process between members who utilise the Trade to Save facility. Once consenting parties have established potential for a compatible trade to proceed, the onus is on you and them to exchange personal contact details for the purpose of continuing negotiations off line, where any contract of sale is formed directly between the parties in isolation to Trade to Save.



6. At Your Own Risk
   All interaction and associated transactions between the members of Trade to Save are conducted by the user entirely at their own risk. Trade to Save accepts no responsibility or liability for any misconduct of any of its members including, without limitation, members that have registered under false pretences with the intention of conducting fraudulent activity. Trade to Save gives no undertakings, representations, or warranties in relation to ownership, accuracy, or expectations of items sold or listed on the Trade to Save web site.



7. Fees and Pricing
   All Trade to Save pricing for membership is inclusive of Goods and Services Tax (GST). Please review our "fees" page for further detail.



8. Member Tax Obligations
   Members are responsible for any tax obligations that may result from transactions arising from the use of Trade to Save. A general overview of possible tax implications has been provided for members' reference. This overview is provided as a general guide only and may not always be up to date. Members should seek independent tax advice for specific advice on their tax positions.



9. Intellectual Property Rights
   Trade to Save owns the intellectual property rights to the Trade to Save website its software and all associated proprietary developments. You may not replicate, copy, reproduce, distribute or seek to provide any commercialised development from the intellectual property owned by Trade to Save or represented on the Trade to Save website with out written permission from Trade to Save Limited.

By registering with Trade to Save, you are agreeing to receive emailed information from Trade to Save notifying you about the other members enquiries in response to  your ad, site announcements, newsletters and associated promotions. You can stop receiving email enquiries from other members by turning off your ad or by requesting to be unsubscribed from Trade to Save
    
    
    
11. From time to time Trade to Save will run promotions where prizes may be offered. The following will apply
    • Every effort will be made to have prizes drawn by an independent person of official title
    • Prizes will only be applicable to those who are active participating members
    • Members will be validated prior to issuing any prize. If validation can not be confirmed this will result in a redraw of the prize
    • If there is no, or incorrect contact information for the member this may result in a redraw of the prize
    • Unless specifically stated the prize can not be exchange for the equivalent monitory value
    • Trade to Save is not responsible if the product is faulty and any warantee applies between the receiver of the product and the outlet where the item was purchased
    • Warantees apply from the time trade to save purchased the item and not when the item was gifted to the prize winner

Trade to Save does not guarantee that no errors will occur with our service or that the service will always be continually available, reliable, secure or that software defects will be rectified.

LIABILITY INDEMNITY & BREACH

Liability: Trade to Save is excluded from liability and responsibility in regard to any loss or damage either, consequential, special, incidental, or indirect including but not limited to the loss of data, profits, and other damages resulting from inability to use the service, negligence, unauthorised access or modification to your data or transmissions.

Indemnity: You hereby agree to indemnify and release Trade to Save, it?s directors and employees, against any and all claims, loss, damages, tax including GST liability and expenses (as well as legal expenses) incurred by us resulting out of, or in connection with, your inability to comply with these Terms and Conditions.

Breach: Trade to Save reserves the right not to register or to remove any user from present and future access to the Trade to Save site at our sole discretion should we feel your activity is compromising the standard of our service through misconduct, illegal use, breach of Terms and Conditions, the provision of false or fraudulent information, improper use for any other reason totally at the discretion of Trade to Save. Trade to Save can at its discretion inform or warn other members of your actions where this is considered appropriate.

GENERAL RULES AND CONDUCT FOR USING TRADE TO SAVE

1. You must be 18 years or older to trade on the Trade to Save web site
2. You must not register multiple user accounts
3. You must not attempt to cause any harm or damage to the Trade to Save web site through the introduction of malicious software
4. You must keep your personal details and passwords confidential, up to date and not disclose this information to other people
5. You can not on-sell or allow other people to use and operate under your registered Trade to Save membership
6. Only full members can disclose personal contact information between each other. You must not attempt to use any form of the service to disclose your personal contact details with any casual members.
7. Politeness, respect and consideration to all members must be observed at all times
8. You will not list any form of illegal matter including sexually explicit material
9. You must provide honest and accurate information pertaining to your personal registration details and information related to your trade items provided.
10. No member shall use the Trade to Save site for purposes other than those intended. Unethical methods to promote user listings in an unquestionable nature, including spam, will be considered abuse of member privileges and shall result in immediate revocation of membership privileges and the forfeiture of any remaining membership prepaid balance.
11. The respective parties who have entered into the exchange of trade items will endeavor to meet all expectations set between parties and trade in good faith
12. You are responsible for all delivery arrangements and possible tax obligations arising from the exchange of trade items.
13. All exchanges involving businesses must comply with the Inland Revenue Departments bartering and tax regulations
14. You must remove your listing from Trade to Save once your term has expired or if the trade item is no longer active or available.
15. You must become a full member to complete a trade
16. You must never pass on personal details or other members that your have obtained through the Trade to Save service.
17. You must not copy, replicate, reproduce, or distribute any material or intellectual property derived from the Trade to Save web site or the use of the service.
